Personal Injury

Injury can occur as a result of someone's negligence, for example, driving a car drunk, violating another traffic law, or falling due to a poorly maintained or designed property. The law recognizes damages for pain, anguish, physical impairment, loss of earning capacity, medical expenses and disfigurement. Also, in the event of death or serious bodily injury, family members have the right to recover for the loss of the love and support of a loved one

Business Litigation

Business litigation covers many areas of law. It can involve contracts to informal relationships. Lawsuits or negotiations can stem from consumer problems to large corporate disagreements.

Pharmaceutical Deaths or Illnesses

There are more and more effective medicines for consumer use; however, sometimes drug manufacturers put medicines on the market that prove to have harmful effects. Some of these side effects can have horrific consequences to the physical and mental well being of the unsuspecting patient. This makes it even more important for the manufacturers of the drugs and those responsible for administering the medicine, such as doctors and pharmacists, to exercise prudence and care.

Nursing Home and Elder Abuse

Taking care of our elder parents and ourselves someday is a large and growing industry. Billions of dollars are spent each year for the cost of elder care. For the most part, this care is provided by corporately operated nursing homes and alternative care facilities. While this is a worthwhile and necessary endeavor, there are cases of elder abuse and neglect by the operators of such facilities. Unfortunately, many elderly residents are not able to protect themselves when such neglect or abuse occurs, and the family learns too little or too late the conditions facing the elder relative and a tragedy follows. Litigation cannot only seek recompense for the harm done but can also motivate the institutions to provide better service to avoid having to pay for their mistakes.

Business and Consumer Fraud Claims

On a far too often basis, we hear about individuals who have been defrauded or cheated in business transactions. These include corporate and stock market investments, general business investments, purchase and contract transactions and other general business affairs. Foley & Small represents individuals and small businesses who have come to be the victim of such fraudulent and, often, criminal activity.

Appellate Law

This refers to legal research and argument. It can range from giving a trial judge authorities for a client's position to filing appellate briefs and arguing in front of a court of appeals or the Supreme Court

Product Liability

When products are unreasonably dangerous and cause injury to a consumer or bystander, the manufacturer and seller must accept the responsibility for the harm. Products can range from tools, machinery, and cars to disease-causing agents such as medicine, drugs, cleaning solvents and the like. A product can be unreasonably dangerous by the manner in which it is manufactured, designed or marketed. The balance test to determine if a product is unreasonably dangerous is the possibility and severity of injury on one scale and the cost or effort necessary to avoid the dangerous condition on the other.
